Terms and Conditions

1. Introduction
The following Terms and Conditions apply to any order placed on sgmark.com.sg. It excludes purchases made from other platforms including but not limited to, Lazada, Carousell and Shopee.

Welcome to SG Mark (“Company”, “we”, “our”, “us”). Please read the terms and conditions carefully before using the website located in www.sgmark.com.sg (“service”). These terms and conditions govern your use of our website and a continued usage of this website constitutes your agreement to be bound by these terms and conditions. These terms apply to all visitors, users and any individual who wish to access our services or use our website.

If you do not agree or comply with the terms and conditions, you may not use the website or service that we provide. Before placing an order, you may contact us at support@segen.com.sg or 6841 5800 if you have any inquiries regarding the terms and conditions. 

2. Purchases and Payments
If you wish to purchase any product or service made available through the website, you may be asked to provide certain information relevant to your purchase, including but not limited to, your credit or debit card number, the expiration date of your card, your billing address and shipping information.

You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any purchase; and that (ii) the information you have provided to us is true, correct, and complete.

Once payment has been made and authorised, and we have determined the availability of the stock, delivery will be arranged for the goods to be delivered. Acceptance of the order and creation of a legally binding contract between us will only occur when the confirmation email has been sent to you.

In the event that there is insufficient stock to satisfy your order, you will be informed immediately. You may choose to seek a full refund or change the product for one of the same prices.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, fraudulent/unauthorised/illegal transactions.

Individuals are not allowed to cancel their order, citing the reason of change in decision, and a refund will not be applicable. If a wrong order has been placed, you may contact us at support@segen.com.sg or 6841 5800.

All prices and charges on this website are quoted in Singapore dollars. The price you pay for your order is the price displayed on the website. The prices do not include GST and delivery charges are calculated as part of the checkout process. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and provide an option for you to reconfirm your order at the correct price or cancel your order. If we are unable to contact you within 24 hours from the first contact made, we will treat the order as cancelled and you will receive a full refund for your purchase.

3. Security
All credit and debit card payments made on our website are protected by a secure connection. This secure connection ensures that your credit or debit card is encrypted before its transfer to the bank for authorization.

No credit or debit card information submitted on our website will be stored or distributed once your order has been processed.

4. Delivery
All delivery services are made by SG Mark Pte Ltd. The delivery fees are based on the delivery of one order to a single address located in Singapore.

Please ensure that you, or a a person who is capable of receiving the delivery is present to receive the delivery on your behalf and you agree that we can rely on that person’s instructions. We are not obliged to verify that that person has been authorised by you to receive the delivery.

A fee of $50 will be imposed for any unsuccessful scheduled delivery and for a re-delivery to be scheduled. We are not obliged to complete the delivery of your order prior to receiving the payment of the fee.

In the event of any unforeseen circumstances (such as lorry breakdown, traffic accident, major traffic delays or severe weather) we will do our best to contact you to rearrange an alternative delivery date and time-slot.

On delivery, it is your responsibility to examine the product(s) to ensure that the correct item was sent. You will be asked to sign the proof of delivery to confirm this. If there are any issues, you should contact us at support@segen.com.sg or 6841 5800 immediately.

Please ensure that there is sufficient access and space for the order to be delivered. SG Mark reserves the right to refuse any requests that were not mentioned prior to the delivery, at our sole discretion. We are not obliged to perform these additional services.

Utmost effort will be made to deliver the order to your stipulated address. If our deliverymen view the location to be unsafe to them or any other person, or that the delivery is unfeasible, we reserve the right to cancel the delivery on the spot. Upon cancellation, a refund of any payments made for that delivery would be provided.

You will become the owner of the goods at the time of the delivery, if we have received full payment for the goods. You will be liable for the loss or destruction of the goods from that point onwards.

For any changes in the scheduled delivery date and time, please contact us at support@segen.com.sg or 6841 5800 two days in advance with your order details. Please note that any change or cancellation in the scheduled delivery date or time-slot might result you in incurring an additional fee of $20.

We will not be responsible for any damage to your property if you fail to comply with this Delivery section of our Terms and Conditions.

5. Distribution of Materials
Content found on or through the website are property of SG Mark and should not be used without permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

6. Refunds
Refund is only applicable for items with major defects or mechanical issues noticed at the point of delivery. Any accidental damage, such as scratches, will not be applicable for refund.

To be eligible for a refund, you are required to contact us at support@segen.com.sg or 6841 5800 with the proof of damage or defect, alongside a proof of purchase, within 7 days from the successful delivery. Once the refund application has been approved, you will receive the refund within 30 days.

If the goods are not returned to us, we reserve the rights to refuse a full refund for the specific item.

If you decide to return an order or item that has been purchased with discount, the amount refunded will be in accordance to the discount provided.

7. Warranty
SG Mark warrants that all items delivered are free of defects. Warranty period varies by product, commencing from the date of purchase.

If a product is deemed defective during the warranty period, SG Mark will repair or replace the parts, whichever SG Mark decides on. This warranty covers the replacement or repair of any product that has a manufacturing or material defect that is not the result of normal wear and tear, misuse of product, or a natural characteristic of the material used.

This warranty is not transferrable. The warranty does not cover products used for commercial purposes.

8. Accounts
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

9. Intellectual Property
Service and its original content (excluding content provided by users), features and functionality are and will remain the exclusive property of SG Mark and its licensors. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of SG Mark.

10. Copyright Policy
We respect the intellectual property rights of others. It is our policy to respond to any claim posted on the website which infringes the copyright policy or other intellectual property rights (“Infringement”) of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to support@segen.com.sg, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “Singapore's Copyright Act for Copyright Infringement Claims”

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any content found on and/or through Service on your copyright.

11. Error Reporting and Feedback
If you have a complaint or remark to make, you may contact us at support@segen.com.sg or 6841 5800, which can be found under the ‘Contact Us’ page.

We will take your feedbacks into consideration and your statutory rights as a consumer remains unaffected.

12. Link to Other Websites
Our service may contain links to third-party websites or services that are not owned or controlled by SG Mark.

SG Mark has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

We strongly advise you to read the terms of service and privacy policies of any third party web sites or services that you visit.

13. Data Protection and Privacy
Information provided to us will remain confidential, and not shared with any third-party providers or services without your consent. We are committed to protecting your privacy. We will only use the information that we collect lawfully and mainly to (i) process your order and (ii) provide you with the best experience on the website.

14. Governing Law
These Terms and Conditions shall be governed and construed in accordance with the laws of Singapore, which governing law applies to agreement without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights. If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court, the remaining provisions of these Terms and Conditions will remain in effect. These Terms and Conditions constitute the entire agreement between us regarding our website and supersede and replace any prior agreements we might have had between us regarding the website.

15. Changes To Service
We reserve the right to withdraw or amend our website, and any service or material we provide via the website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the website, or the entire website, to users, including registered users.

16. Amendments To Terms
We may amend Terms and Conditions at any time by posting the amended terms on this site. It is your responsibility to review them periodically.

Your continued use of the website following the posting of revised Terms and Conditions means that you accept and agree to the changes. If you do not agree to the new Terms and Conditions, you are no longer authorised to use Service.

17. Waiver And Severability
No waiver by SG Mark of any term or condition set forth in Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Company to assert a right or provision under Terms shall not constitute a waiver of such right or provision.

If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.

By using service or other services provided by us, you acknowledge that you have read these terms of service and agree to be bound by them.
